Amendments to the Law on Assistance to Ukrainian Civilians stipulate right of the Ukrainian civilians residing in Latvia with their children to receive the childbirth allowance, childcare benefit and the state family allowance, as defined by the Law on State Social Allowances.
Childbirth allowance is disbursed if the child was born in Latvia on or after 24 February 2022. The allowance is also disbursed if the parent has not yet been issued a visa or temporary residence permit at the moment of birth.
For example, if the child was born in Latvia on 28 February, but visa for the mother and child was issued from 10 March, the benefit is due.
Childcare benefit and state family allowance are granted and paid for the period for which the long-stay visa or temporary residence permit has been issued, but from no earlier date than 5 March.
For example, a mother and her 8-year-old child arrived in Latvia from Ukraine on 26 February, and they have been issued a visa valid from 27 February 2022 to 27 February 2023. In this case, the state family allowance will be granted from 5 March, when the Law on Assistance to Ukrainian Civilians entered into effect. If the visa has been issued, for example, from 20 March 2022, the child allowance will be granted from that date.
Eligibility:
- the parent with his/her and child reside in Latvia,
- a long-stay visa or a temporary residence permit has been received,
- an account with a Latvian credit institution or the Postal Payments System (PNS) has been opened,
- an application has been submitted to the State Social Insurance Agency (SSIA).
Application in Latvian and Ukrainian "Application for Child Allowances for an Ukrainian Civilian"
The application can be submitted to the SSIA by the applicant in person:

The following documents must be presented at the time of application:
- parent's passport or ID card,
- the child's birth certificate,
- a long-stay visa or temporary residence permit issued to the parent and child.
Допомога на дитину громадянському населенню України, що присвоюється Державним агентством соціального страхування
Внесеними до Закону про підтримку громадянського населення України поправками встановлено право громадянського населення України, яке проживає разом з дітьми в Латвії, на отримання встановленої Законом Про державну соціальну допомогу допомоги по народженню дитини, допомоги по догляду за дитиною та державної сімейної допомоги.
Допомога по народженню дитини виплачується, якщо дитина народилася в Латвії 24 лютого 2022 року або пізніше. Допомога також виплачується, якщо батькам на момент народження дитини ще не була видана віза або тимчасовий вид на проживання.
Наприклад, допомогу належить виплатити, якщо дитина народилася в Латвії 28 Лютого, а віза матері і дитині видана 10 березня.
Допомога по догляду за дитиною і державна сімейна допомога присвоюється і виплачується за період, на який видана довгострокова віза або тимчасовий вид на проживання, але не раніше, ніж з 5 березня.
Наприклад, мати разом з 8-річною дитиною з України прибула до Латвії 26 лютого, і їм видана віза терміном дії з 27 лютого 2022 року до 27 лютого 2023 року. У такому разі державну сімейну допомогу буде присвоєно з 5 березня, коли набув чинності Закон про підтримку громадянського населення України. У свою чергу, якщо віза видана, наприклад, 20 березня 2022 року, допомогу на дитину буде присвоєно з цієї дати.
Умови отримання допомоги:
- мати з дитиною живе в Латвії;
- отримана довгострокова віза або тимчасова посвідка на проживання;
- відкрито рахунок в латвійський кредитній установі або Поштовій розрахунковій системі (ПРС);
- подано адресовану Державному агентству соціального страхування (ДАСС) заяву.

- паспорт або посвідчення особи матері;

- видана матері і дитині довгострокова віза або тимчасовий вид на проживання.
Starting from 27 May, the State Social Insurance Agency (SSIA) will grant the following benefits to Ukrainian civilians specified in the Law on State Social Benefits: care allowance for a disabled child, care allowance for a disabled person in need of care, supplement to the family state allowance for a disabled child, state social security allowance in case of disability and old age, as well as the state support for children with coeliac disease specified in the Law on Social Assistance and Social Services. The SSIA will pay these benefits to the Ukrainian civilian as long as his/her long-term visa or temporary residence permit is valid.
It is provided for by the amendments to the Law on Support of Ukrainian Civilians.
Conditions for receiving services:
- The person lives in Latvia,
- A long-stay visa or a temporary residence permit has been received,
- A document (decision, opinion, certificate) issued in Latvia on a disability, indication or diagnosis of coeliac disease,
- An account has been opened with a Latvian credit institution or the Postal Payments System (PNS).
Care allowance for a disabled child and care allowance for a disabled person in need of care is granted:
- if the State Medical Commission of Health and Capacity to Work (medical commission) has provided information on the disability of the Ukrainian civilian - child or adult and an opinion on the need for special care,
- from the date of the opinion of the medical commission,
- for the period set out in the opinion.
! Application to the SSIA is required. The opinion will be obtained by the SSIA from a panel of doctors.
The surcharge to the family state allowance for a disabled child is granted, based on information received from the medical commission about the child's disability. The surcharge is paid for the duration of the child's established disability.
Application to the SSIA is required. The SSIA will receive information about the child's disability from the medical commission.
State social security benefit in case of disability and old age is granted to a Ukrainian civilian who is not entitled to a state pension or insurance indemnity in the Republic of Latvia, provided that the person has resided in Latvia for at least three months since the date of issue of the long-term visa or temporary residence permit.
Application to the SSIA is required. The SSIA will receive information about the disability from the medical commission.
State aid is granted to children with coeliac disease from the date of a certificate from a family doctor or gastroenterologist stating that the diagnosis is coeliac disease.
!You need an application to the SSIA together with a certificate from a doctor in Latvia.
Important to note!
A person who no longer lives in Latvia, for example, returns to Ukraine or goes to live in another country, is not entitled to receive the state social benefits granted in Latvia, therefore the beneficiary is obliged to inform the SSIA if the beneficiary or the child for whom the benefit is received ceases to reside in Latvia and leaves the country.

These conditions apply to Ukrainian civilians who reside in Latvia and have obtained a long-stay visa or residence permit in accordance with The Law on Support of Civilians of Ukraine.
Request of pension
If a Ukrainian civilian has reached the conditions for granting an old-age pension (retirement age in Ukraine and/or Latvia), invalidity pension (established invalidity in Latvia) or survivor's pension (deceased supporter), he/she may request an assessment of his/her entitlement to a Ukrainian and/or Latvian pension, as provided for in Latvian-Ukrainian Treaty. Therefore, an application must be submitted to the State Social Insurance Agency (SSIA), requesting the type of pension in question.
If you apply for a Ukrainian pension, you must fill in application for granting or renewal of pension, which will be forwarded by the SSIA to the competent Ukrainian authority for examination.
Length of insurance period
When determining the length of insurance for granting a pension, provisions of the Latvian-Ukrainian Treaty will be taken into account, but with the difference that the competent authority of Ukraine will be responsible for granting a pension for the length of service in Ukraine and Latvia before 31 December 1990 and in Ukraine after 1 January 1991. But the SSIA will be responsible for granting a pension for the length of service in Latvia after 1 January 1991. Therefore, the fact of residence in Ukraine on 24 February 2022 will be taken into account for the purpose of determining the length of service.
Disbursement of pension
During their stay in Latvia, Ukrainian civilians can choose to receive the pension already granted in Ukraine or that will be granted anew:
- via the SSIA on a quarterly basis, as provided for by The Latvian-Ukrainian Treaty by submitting an application addressed to the SSIA for the granting or renewal of a Ukrainian pensionwhich will be forwarded by the SSIA to the competent authority of Ukraine.
- in accordance with the pension disbursement procedure adopted in Ukraine.
This option does not apply to the disbursement of Latvian pension, since a Ukrainian civilian staying in Latvia must receive it in Latvia. A Ukrainian civilian who receives a Latvian pension must inform the SSIA about his/her stay in Latvia and submit an application for change of bank account or disbursement address.
The SSIA will disburse the pension granted to a Ukrainian civilian in Ukraine or Latvia only until the expiry of the long-term visa or residence permit. After that, the person has to make arrangements regarding the disbursement of pension at the SSIA according to the further acquired residence status in Latvia.
Important to note!
To receive a pension, when submitting an application to the SSIA, you must provide your residential address in Latvia and a contact number.
A person who no longer stays in Latvia, for example, returns to Ukraine or leaves to reside in another country before the expiry of a long-term visa or residence permit, is obliged to inform the SSIA.

Особливі умови призначення та виплати пенсій цивільному населенню України
Ці умови поширюються на цивільних жителів України, які проживають у Латвії та отримали довгострокову візу або дозвіл на проживання відповідно до Закону про підтримку цивільного населення України.
Оформлення пенсії
Якщо цивільному жителю України настали умови для призначення пенсії за віком (досягнуто визначеного в Україні та/або Латвії пенсійного віку), пенсії по інвалідності (встановлена в Латвії інвалідність) або пенсії у зв’язку з втратою годувальника (помер годувальник), він може вимагати оцінки права на присвоєння української та/або латвійської пенсії, як це передбачено латвійсько-українським договором. Таким чином, до Державного агентства соціального страхування (ДАСС) потрібно подати заяву про призначення відповідного виду пенсії.
Якщо вимагається українська пенсія, потрібно заповнити заяву про призначення або поновлення пенсії, яку ДАСС перенаправить для розгляду до компетентного органу України.
Страховий стаж
При визначенні страхового стажу для призначення пенсії водночас будуть враховуватися положення латвійсько-українського договору, але з тією різницею, що компетентний орган України відповідатиме за призначення пенсії за вислугу років в Україні та Латвії до 31 грудня 1990 року, а також в Україні – після 1 січня 1991 року. А ДАСС відповідатиме за призначення пенсії за вислугу років у Латвії після 1 січня 1991 року. Таким чином, для визначення стажу буде враховуватися факт проживання особи в Україні станом на 24 лютого 2022 року.
Виплата пенсії
Цивільний житель України під час перебування в Латвії уже призначену в Україні пенсію або пенсію, яку буде призначено заново, може отримати наступним чином:
- за допомогою ДАСС один раз на квартал, як це передбачено латвійсько-українським договором, шляхом подання адресованої ДАСС заяви про призначення або поновлення української пенсії, яку ДАСС перенаправить до компетентного органу України.
- згідно з прийнятим в Україні порядком виплати пенсії.
Цей вибір не стосується виплати латвійської пенсії, оскільки цивільний житель України, який перебуває в Латвії, повинен отримувати її в Латвії. Цивільний житель України, який отримує латвійську пенсію, повинен повідомити ДАСС про своє перебування в Латвії та подати заяву про зміну банківського рахунку або адреси виплати.
Цивільному жителю України ДАСС здійснюватиме виплату призначеної в Україні або Латвії пенсії лише до закінчення терміну дії довгострокової візи чи дозволу на проживання. Після цього виплата особі пенсії здійснюватиметься ДАСС відповідно до отриманого в Латвії статусу проживання.
Важливо зауважити!
Для отримання пенсії при поданні заяви до ДАСС необхідно вказати адресу свого проживання в Латвії та номер телефону для зв’язку.
Особа, яка більше не проживає в Латвії, наприклад, повертається до України або переїжджає в іншу країну до закінчення терміну дії довгострокової візи або дозволу на проживання, зобов’язана повідомити про це ДАСС.
