Benefit For A Disabled Person In Need Of Care

The allowance is not granted to persons with temporary residence permits.

The allowance may be granted to individuals who are over 18 years of age and who have been assigned disability and issued an opinion on the necessity for special care by the State Medical Commission for the Assessment of Health Condition and Working Ability (VDEĀK).

Payment of the allowance to a disabled person who needs care is terminated, when the period of disability and the necessity for special care ends.

The allowance is granted in accordance with Section 12.1 of the Law on State Social Allowances and Cabinet Regulation No. 1608 of 22 December 2009 Regulations Regarding the Amount of an Allowance to a Disabled Person who Needs Care, Procedures for the Review of the Amount of an Allowance and Procedures for the Granting and Disbursement of an Allowance.

The benefits’ claiming rules

Grounds for awarding the benefit:

  • Application for receiving the benefit

An application you can submit in one of the divisions of the State Social Insurance Agency (SSIA) or:

  • personally or as electronic document, in accordance with the legal regulation of the processing of the electronic documents;
  • sent by post or submit by a notary authorized person’s intermediation;
  • submit in one of the customer service centers of the state or local governments, which have the cooperation agreements with SSIA.

The easiest way to do this by filling in an E-application to the state and local governments’ services portal www.latvija.lv

When applying for the allowance by post or e-mail application form in the webpage of the SSIA www.vsaa.gov.lv can be used or a free text application.

By signing the application, the person requesting the benefit confirms that the information provided in the application is accurate.

Information on a disabled person, regarding whom an opinion is issued on the necessity of special care due to severe functional impairment shall be submitted to VSAA by the State Medical Commission for the Assessment of Health Condition and Working Ability electronically.

The benefit may be requested through an authorised person, provided that the representation rights have been granted in accordance with Article 38 Paragraph one of the Administrative Procedure Law. Representation of a natural person shall be drawn up as a notarised power of attorney, or a natural person may authorise his or her representative at the VSAA office, if both the representative and the authorising person are present.

The rates of the benefits

The amount of the allowance for a disabled person in need of care is € 213.43 per month.

An increased benefit amount is established from 2019 July 1st for persons whose cause of disability is illness since childhood.

The benefit amount for a disabled person who needs caretaking and whose cause of disability is illness since childhood is EUR 313.43 per month.

Information for the receivers of the benefit to whom the benefit has already been granted and whose cause of disability is illness since childhood.

No application needs to be filed for revision of the benefit amount.
SSIA will recalculate the benefit starting with 1 July 2019 and will pay out the calculated difference until 1 September 2019.

Time for claiming

The application must be submitted not later than within 6 months from the moment when the right is created. If the benefit is applied for later it is granted only for the previous 6 months prior to the application for the benefit.

Time for decision

Decision on granting of the benefit is made within a month after the department of the SSIA has received all the documents and other information necessary to grant the allowance.

The payment of the allowance is discontinued

  • for the period of time while the recipient of the allowance is fully provided for by the state (in a state-funded institution of prolonged social care or social rehabilitation or in a penal institution);
  • if the recipient of the allowance leaves the Republic of Latvia to permanently live abroad.

Receipt of the benefit

Allowance to a disabled person who needs care may be provided at the beneficiary’s place of residence or transferred to the beneficiary’s account at a credit institution or Postal Accounting System (PAS).

If the beneficiary is deceased, the allowance granted but not received before the beneficiary’s death may be obtained by the beneficiary’s spouse and all first- or second-degree relatives.

When applying for the granted allowance not received due to death of the recipient of the allowance an application for payment of the allowance not received in case of the death of the recipient of the allowance must be submitted. The application can be sent also by post or in electronic form in accordance with the regulatory enactments regarding drawing up of electronic documents.
