State Support for the Children Suffering from Celiac Disease

  • children up to 18 years of age (have not come of age);
  • children after reaching 18 years of age (after coming of age), if the child is studying at an institutions of general education or vocational education and has not reached 20 years of age or is a day student at an institution of higher education (full-time studies) and is no older than 24 years of age.

If the child:

  • has been granted a personal identity code (except for children residing in Latvia with a temporary residence permit);
  • is a permanent resident of Latvia;
  • is not fully provided for by the state or local government.

The support is provided according to Section 13(1)8 of the Social Services and Social Assistance Law.

The amount of the support and the conditions for granting of the support is established in the Cabinet Regulation No. 261 “Regulations Regarding the State Support for the Children Suffering from Celiac Disease” of 21.05.2013.

The support is provided to:

  • one of the parents of the child;
  • an adopter;
  • a guardian or a member of the foster family;
  • the person taking care of the child before the adoption;
  • another person actually taking care of the child, if a corresponding decision of the orphan’s court has been made for the protection of the child’s personal interests;
  • to the child after he/she has come of age;
  • to the child after he/she become 15 years old, if a corresponding decision of the orphan’s court has been made for the protection of the child’s personal interests.

The support is granted for a period until the repeated examination set in the health certificate (but no longer than 2 years).

The supports’ claiming rules

Grounds for awarding the support:

  • a written application for granting of the support;
  • a written statement by a certified gastroenterologist stating the diagnosis – celiac disease and term of repeated examination not exceeding two years from the day of issue of the statement.

An application you can submit in one of the divisions of the State Social Insurance Agency (SSIA):

  • personally;
  • sent by post or submit by a notary authorized person’s intermediation.

When applying for the benefit by post application form in the webpage of the State Social Insurance Agency www.vsaa.gov.lv can be used or a free text application.

By signing the application, the person requesting the benefit confirms that the information provided in the application is accurate.

The benefit may be requested through an authorised person, provided that the representation rights have been granted in accordance with Article 38 Paragraph one of the Administrative Procedure Law. Representation of a natural person shall be drawn up as a notarised power of attorney, or a natural person may authorise his or her representative at the VSAA office, if both the representative and the authorising person are present.

If the child is at least 18 years of age and is studying, one must submit the following:

  • a statement of an institution of vocational education, if the support is requested for a child, who is not older than 20 years of age (is a student of Latvian educational institution or a foreign educational institution);
  • a statement of an institution of higher education, if the support is requested for a child, who is not older than 24 years of age and is a day/full-time student (a student of Latvian educational institution or a foreign educational institution);
  • a statement of an institution of general education, if the support is requested for a child, who is not older than 20 years of age and is a student of a foreign educational institution.

If the child is studying in a general educational institution in Latvia, the statement of the institution does not have to be submitted, as the State Social Insurance Agency (SSIA) receives this information electronically from the Ministry of Education and Science.

About a statement of an educational institution issued abroad

Education certificate issued abroad that certifies the fact of acquiring education in a general educational and vocational education institution or an institution of higher education is compared to a statement issued by a general educational and vocational education institution or an institution of higher education in Latvia, if the document meets the following requirements:

  • the education certificate issued abroad contains information that allows making a clear conclusion that the child, to whom the document has been issued, within the specified period has acquired education in the day department of a general educational and vocational education institution or an institution of higher education (full-time studies);
  • a translation is attached to the education certificate issued abroad according to the statutory procedure on the usage of the official language;
  • statutory procedure of document legalization has been complied with.

If the document has been issued in a member state of the EU, EEA or the Swiss Confederation, contracting states – Russia, Belarus, Ukraine – legalization is not required.

Payment of the support after repeated health examination of the child is continued, if the examination is carried out within the period specified in the health certificate.

If the repeated examination is not carried out within the period specified in the health certificate, the payment of the support is continued as of the day, when the health certificate is issued (but no more than for 12 previous months, starting from the day of requesting of the support).

Conditions for the disbursement of the support

The payment of the support is discontinued:

  • for the period of time while the recipient of the support or the child is placed in a penal institution or receives fully state-funded prolonged social care or social rehabilitation services;
  • if the child is placed in a nursing and education institution and is fully provided for by the state or local government;
  • if a decision of the orphan’s court has been made for the protection of the child’s personal interests regarding the discontinuation of the payment of support to a person not actually taking care and not raising the child;
  • if the guardianship rights have been suspended or the recipient has been deprived of this right, or the child has been sent to be cared for by a foster family or a guardian;
  • if the child’s stay at a foster family or a guardian has been terminated with a decision of the orphan’s court;
  • if the recipient or the child leaves the Republic of Latvia to permanently reside abroad;
  • if the recipient of the support gives up the allowance on his/her own free will;
  • if the recipient or the child has passed away.

Payment of the support to children, who continue their studies after becoming 18 years old:

If the statement or information about the current academic year is not submitted to (received by) the SSIA, payment of the support is discontinued as of October 1. Support for students of the last grade/study year is discontinued as of July 1.

Payment of the support is resumed as of the next calendar month after the electronically provided information or the day of receipt of the statement.

Unpaid amount of support that is due for the previous months is added to the support for the previous month.

The amount of the support

The amount of the support corresponds to the amount of the additional payment to the state family allowance for a disabled child, namely, 106.72 euro.

Time for claiming

If the support is requested within 12 months after the issue of a health certificate, the support is granted as of the day of issue of the certificate.

If the support is requested later than within 12 months after the issue of a health certificate, the support is granted only for the previous 12 months, starting from the day of requesting of the support.

Time for decision

Decision on the granting or rejection of the support is made by the SSIA within 10 business days after the receipt of the request.

Receipt of the support

State support for the children suffering from celiac disease is transferred to the recipient’s account in a credit institution or a postal account system (PAS).
