Consideration for the Care of an Adopted Child

having a personal identity number with children taken into his/her care who have been assigned a personal identification number are entitled to receive consideration for the care of an adopted child (hereinafter – consideration) and additional payment for the simultaneous care and supervision of several adopted children (hereinafter – additional payment). Consideration is not granted to persons with temporary residence permits.

Consideration and additional payment are granted to the adopter who, according to the resolutions of the orphan’s court before the approval of the adoption by the court, has taken into care and supervision the child to be adopted.

The consideration is granted according to Section 61 of the Law on State Social Allowances and Cabinet Regulation No 752 adopted on 12.12.2017 “Procedures for the Granting and Disbursement of a Remuneration for the Care of an Adopted Child” (became effective on 01.01.2018).

The consideration’ claiming rules

Grounds for awarding the allowance:

  • Application for receiving the allowance.

An application you can submit in one of the divisions of the State Social Insurance Agency (SSIA):

  • personally or as electronic document, in accordance with the legal regulation of the processing of the electronic documents;
  • sent by post or submit by a notary authorized person’s intermediation.

When applying for the allowance by post or e-mail application form in the webpage of the State Social Insurance Agency www.vsaa.gov.lv can be used or a free text application.

By signing the application, the person requesting the benefit confirms that the information provided in the application is accurate.

If the applicant is employed for no more than 20 hours a week, the applicant must submit not only the application, but also the employer’s statement about the applicant’s working hours, stating that the person has a part-time job (specifying the number of working hours a week).

Information about the adopter taking care of the child is provided to the SSIA by the orphan’s court that has made the decision of sending the child to be cared for by the adopter.

Amount of consideration

The amount of consideration depends on the age of the child to be adopted and the fact of employment of the adopter (is he/she is employed or self-employed, or not), as well as on the fact of being on unpaid vacation due to the need to take care of the child.

Consideration and parents’ benefit cannot be received at the same time for the same child.

The adopter, who is taking care of a child under the age of 1,5 years and who is on vacation related to the child care, can choose either to receive consideration, or the parents’ benefit.

The amount of the additional payment

If before the adoption according to the resolution of the orphan’s court several children are placed into care, an additional payment in amount of 171 euro per month is granted for every following child simultaneously put into care.

Time for claiming

The documents for granting of the remuneration must be submitted within 6 months after the day, when the adopter starts taking care of the child according to the decision of the orphan’s court.

Time for decision

Decision on granting of the benefit is made within a month after the department of the SSIA has received all the documents and other information necessary to grant the allowance.

Receipt of the benefit

The remuneration for the care of an adopted child is transferred to the recipient’s account in a credit institution or a postal account system free of charge.

 

Remuneration for the care of an adopted child

The following persons are entitled to receive the state social security allowance – remuneration for adoption of a child – citizens and non-citizens of Latvia, foreigners and stateless persons, who have been assigned a personal identity number, living in Latvia.

People who have received a temporary residence permit in Latvia are not entitled to receive the remuneration.

The remuneration is granted to the adopter, after the court judgment on approval of the adoption comes into force. Remuneration for adoption of a child is paid for each child, who has been in out-of-family care (in an institution of out-of-family care, a foster family, living with a guardian). The remuneration is not granted, if a person has adopted a child of his/her spouse.

The remuneration is granted according to Section 81 of the Law on State Social Allowances and Cabinet Regulation No. 1533 of 22 December 2009 “Procedures for the Granting and Disbursement of Remuneration for Adoption of a Child”.

The court that has approved the adoption shall notify the SSIA about it within three business days after the judgment coming into force.

The allowance may be requested through an authorised person, provided that the representation rights have been granted in accordance with Article 38 Paragraph one of the Administrative Procedure Law. Representation of a natural person shall be drawn up as a notarised power of attorney, or a natural person may authorise his or her representative at the VSAA office, if both the representative and the authorising person are present.

The rates of the benefits

The amount of the remuneration for adoption of a child is 1422.87 euros.

Time for claiming

The documents for granting of the remuneration must be submitted within 6 months after the day, when the adoption is approved.

Time for decision

Decision on granting of the benefit is made within a month after the department of the SSIA has received all the documents and other information necessary to grant the allowance.
